These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BathoHR ("Company," "we," "us," or "our"). By accessing and using our website and services, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our services.

2. Service Description

BathoHR provides a comprehensive Human Resources Management platform designed to streamline HR processes, including:

• Employee management and administration
• Leave and attendance tracking
• Payroll and benefits management
• Performance management
• Compliance and document management
• Analytics and reporting

3. User Responsibilities

As a user of BathoHR, you agree to:

• Provide accurate and complete information during registration
• Maintain the confidentiality of your login credentials
• Use the service only for lawful purposes
• Not engage in unauthorized access or hacking attempts
• Not transmit malware, viruses, or harmful code
• Not violate any applicable laws or regulations
• Not infringe on intellectual property rights
• Not harass, abuse, or threaten other users

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials and password. You agree to:

• Notify us immediately of any unauthorized access
• Log out of your account when using shared devices
• Use strong, unique passwords
• Not share your credentials with others

BathoHR is not responsible for any loss or damage resulting from unauthorized access to your account due to your negligence or failure to protect your credentials.

5. Intellectual Property Rights

All content, features, and functionality of BathoHR (including but not limited to software, design, text, graphics, and logos) are the exclusive property of BathoHR or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use BathoHR for your personal or business use. You may not:

• Reproduce, distribute, or transmit any content
• Modify, adapt, or create derivative works
• Reverse engineer or decompile the software
• Remove or alter any proprietary notices

6. Data and Privacy

Your use of BathoHR is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.

You retain ownership of all data you upload to BathoHR. By uploading data, you grant us a license to use, store, and process that data to provide our services. We will not share your data with third parties without your consent, except as required by law.

7. Limitation of Liability

To the fullest extent permitted by law, BathoHR and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or unavailability
• Errors or omissions in content
• Unauthorized access to your data

Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

8. Disclaimer of Warranties

BathoHR is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, completeness, or timeliness of content
• Uninterrupted or error-free service

You use BathoHR at your own risk. We do not guarantee that the service will meet your requirements or that it will be secure, uninterrupted, or error-free.

9. Subscription and Payment

BathoHR offers various subscription plans. By subscribing, you agree to:

• Pay the subscription fee according to the selected plan
• Provide accurate billing information
• Authorize us to charge your payment method
• Notify us of any billing issues or disputes

Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing cycle. No refunds will be issued for partial months.

10. Termination

We may terminate or suspend your account and access to BathoHR immediately, without prior notice or liability, for:

• Violation of these Terms
• Illegal or fraudulent activity
• Non-payment of subscription fees
• Abuse of our services
• Any other reason at our sole discretion

Upon termination, your right to use BathoHR ceases immediately. We may delete your account and data after a reasonable retention period.

11. Indemnification

You agree to indemnify, defend, and hold harmless BathoHR and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:

• Your use of BathoHR
• Your violation of these Terms
• Your violation of any law or third-party rights
• Your content or data uploaded to the service

12. Dispute Resolution

Any disputes arising from these Terms or your use of BathoHR shall be governed by the laws of Botswana. You agree to submit to the exclusive jurisdiction of the courts of Botswana.

Before pursuing legal action, we encourage you to contact us to resolve the dispute informally.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of BathoHR after such changes constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if not possible, severed. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and BathoHR regarding your use of our services and supersede all prior negotiations, representations, and agreements.
